  • Post or transmit any content that is infringing, defamatory, obscene, or otherwise objectionable.

4. Intellectual Property

• The Service, including its design, text, graphics, logos, icons, software, and content (excluding User Data as defined below), is owned by Make Life Great, Inc. or its licensors and is protected by intellectual property laws.
• Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.
• You retain ownership of the golf scorecard and shot data you input into the Service ("User Data"). By submitting User Data, you grant Make Life Great, Inc. a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, modify (for formatting and analysis purposes), and display your User Data solely to provide the analytics and recommendations service to you and to improve the Service (e.g., for aggregated, de-identified analysis).

• You agree to provide valid payment information to Stripe and to pay all fees associated with your chosen plan or services.

DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE COMMERCIAL EFFORTS TO KEEP THE SERVICE OPERATIONAL BUT DO NOT GUARANTEE THE AVAILABILITY OF THE SERVICE.

MAKE LIFE GREAT, INC. DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF THE GOLF ANALYTICS, RECOMMENDATIONS, OR OTHER INFORMATION PROVIDED THROUGH THE SERVICE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MAKE LIFE GREAT, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT MAKE LIFE GREAT, INC. HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF MAKE LIFE GREAT, INC. EXCEED THE AMOUNT YOU HAVE PAID TO MAKE LIFE GREAT, INC. FOR THE SERVICE IN THE PAST SIX MONTHS, IF ANY, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless Make Life Great, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.
